Under certain circumstances, the language and other markings on the face of a plat may be sufficient to create an express easement. Appellant Katherine Potts brought this action seeking a determination that a 1998 plat granted her an ingress and egress easement across Duane and Cheryl Smiths property. But because the markings on the plat did not evidence any intent to create the alleged easement, we affirm the trial courts dismissal of Potts claims on summary judgment. We also deny the Smiths cross appeal, concluding that the trial court did not abuse its discretion by refusing to award attorney fees.
